PRIVACY POLICY

Isuzu Vietnam Co., Ltd. business registration number 0301236665 (hereinafter referred to as “We” or “IVC”), in its capacity as the Controller and Processor of personal data, is committed to respecting each individual’s privacy and protecting personal data and consumer information in accordance with the laws of Vietnam.

This Privacy Policy (“Policy”) applies to any Personal Data Subject or Consumer who has provided, is providing, or will provide Personal Data and Consumer Information to us, including but not limited to customers, employees, family members of employees, job applicants, personnel of IVC’s members, dealers, suppliers of goods and services to IVC, their contractors, competent state authorities, any other organizations or individuals related to IVC’s investment, manufacturing, business, and operational activities, or their representatives.

We encourage Personal Data Subjects and Consumers to read this Policy carefully and to regularly check IVC’s website for any changes that We may make under the terms of this Policy.

A. PERSONAL DATA AND CONSUMER INFORMATION PROTECTION PRINCIPLES

 

1. Definitions and interpretation

a. Personal Data means digital data or information in other forms that identifies or helps identify a specific individual, including basic personal data and sensitive personal data. Personal data that has been de-identified shall no longer constitute personal data.

b. Personal Data Subject means the individual to whom the personal data relates.

c. Processing of Personal Data means any operation or activity performed on personal data, including one or more of the following: collection, storage, use, analysis, aggregation, encryption, decryption, editing, updating, deletion, destruction, de-identification, provision, disclosure, transfer of personal data, and other activities affecting personal data.

d. Consumer means a person who purchases or uses products, goods, or services supplied by IVC for the consumption or daily-life purposes of an individual, family, agency, or organization, and not for commercial purposes.

e. Consumer Information includes Personal Data and information about the Consumer’s and use of products, goods, and services, and other information relating to transactions between the Consumer and IVC or IVC’s dealer network.

2. Personal Data processed by IVC

Depending on the purpose of Processing of Personal Data as described below, the Personal Data that We need to process may, on a case-by-case basis, include one or more of the following categories:

a. Basic Personal Data

Full name, middle name, and given name as stated on the birth certificate; contact address; nationality; date of birth; personal image; telephone number; gender; personal identification number; place of birth; passport number; place of birth registration; driver’s license number; permanent residence registration place; vehicle registration plate number; temporary residence registration place; marital status; current place of residence; information on family relationships (parents, children, spouse); hometown; information relating to an individual’s digital accounts such as email address and bank account number; and other information associated with or helping identify a specific individual not falling within the above categories, such as vehicle VIN, educational background, and employment history.

b. Sensitive Personal Data

Data revealing racial origin or ethnic origin; an individual’s location identified through location services; images of identity cards, citizen identity cards, or people’s identity cards; health status; biometric data and genetic characteristics such as facial recognition used for employee attendance recording; financial and credit information, and information on customers’ financial transaction history and activities, securities, and insurance maintained at credit institutions, foreign bank branches, providers of intermediary payment services, securities institutions, insurance institutions, and other licensed organizations; data reflecting behavioral tracking and the use of telecommunications services, social networks, online communication services, and other services in cyberspace, such as user cookies.

3. Purposes and scope of processing of Personal Data and Consumer Information

3.1. We process personal data, consumer information on the following grounds:

– The consent of the Personal Data Subject, Consumer information.

– Contractual obligations.

– Legal obligations.

– Cases where consent is not required under applicable laws.

3.2. We process Personal Data and Consumer Information to the extent necessary and lawful for the following purposes:

Provision of products and services;

– To manage the relationship between IVC and customers.

– To communicate or provide advice to dealers, customers, members of IVC, companies within the Isuzu group, and any parties participating in contractual relations with IVC, whether online or in person, regarding IVC’s products and services and other information such as research and analysis newsletters that may be of interest to customers.

Customer care;

– To ensure customer satisfaction and provide professional support to customers.

– To respond to inquiries, handle requests and complaints, and retain records of interactions, comments, and/or complaints received from customers.

For IVC’s operational activities;

– To identify issues relating to products and services;

– To conduct and/or improve business activities and business efficiency;

– To plan improvements and develop products and services;

– To prepare reports, statistics, analyses, and market research;

– To support IVC’s management and administration activities;

Marketing: to develop and carry out any marketing activities and communicate information to customers through online and offline forms and tools (such as email, telephone, postal mail, digital platforms, and social media) concerning products and services that customers may be interested in.

To submit required reports to relevant authorities.

To submit post-training reports to customers’ managing companies.

Recruitment;

Human resources and administration management: implementation of labor contracts in accordance with law, and deployment of policies and procedures to maintain and develop employees’ capabilities and motivation in order to meet IVC’s operational needs.

Consent to all of the above purposes.

3.3. Data processing methods, Consumer information: IVC may process personal data and consumer information by one or more of the following methods: in writing; via recorded calls; via consent syntax by SMS; via email; on websites, platforms, or applications with technical settings to record consent; or by other appropriate methods that can be printed or copied in writing, including in electronic form or other verifiable formats. Personal data and consumer information may be collected or received by IVC directly from the personal data subject, or from public sources and other third parties, such as social media pages, public websites, newspapers, online publications, or information service providers.

Procedure for processing Sensitive Personal Data:

– Step 1. Determine the purpose, scope, and type of sensitive personal data to be processed.

– Step 2. Verify the legal basis for processing.

– Step 3. Carry out the processing.

– Step 4. Monitor and control the processing.

– Step 5. Terminate the processing.

4. Organizations and individuals involved in the Processing of Personal Data, Consumer Information, and cross-border transfer of personal data, as applicable

In addition to IVC, the provided Personal Data and Consumer Information may be processed by the following organizations and individuals in accordance with the purposes consented to by the Personal Data Subject or Consumer:

4.1. IVC’s dealers, members of IVC, companies within the Isuzu group, suppliers of goods and services to IVC, their contractors, competent state authorities, or any other organizations or individuals related to IVC’s investment, manufacturing, business, and operational activities, or their representatives (provided that such parties have entered into confidentiality undertakings with IVC, except where the recipient is a professional adviser such as a financial adviser, audit firm, or law firm and is bound by professional confidentiality obligations);

4.2. Any party that the Personal Data Subject or Consumer instructs IVC to share Personal Data or Consumer Information with.

These related parties are obliged to protect personal data and consumer information by appropriate safeguards and in accordance with applicable laws.

5. Rights and obligations of Personal Data Subjects and Consumers

5.1 Rights of Personal Data Subjects and Consumers:

– The right to be informed of personal data processing activities; to consent or refuse consent; and to withdraw consent for personal data processing;

– The right to access, amend, or request amendment of personal data;

– The right to request provision, deletion, or restriction of personal data processing, and to object to personal data processing;

– The right to complain, denounce, initiate legal proceedings, and claim damages in accordance with law;

– The right to request competent authorities or relevant agencies, organizations, or individuals involved in personal data processing to implement measures and solutions to protect their personal data in accordance with law;

– Where an incident or violation of personal data protection regulations is detected, the Personal Data Subject may notify IVC so that IVC may implement appropriate protection measures and solutions. IVC shall respond, provide full information on procedures, and take remedial actions within the period prescribed by law;

– The right to permit or refuse IVC to: (i) share, disclose, or transfer information to third parties, except where IVC transfers information lawfully collected in accordance with the Law on Protection of Consumer Rights and other relevant laws to third parties for storage or analysis in support of IVC’s business operations, provided that the parties have entered into a written agreement under which the third party is responsible for protecting Consumer Information as required by the Law on Protection of Consumer Rights; and (ii) use Consumer Information for advertising, marketing products, goods, or services, and conducting other commercial activities.

5.2. Obligations of Personal Data Subjects and Consumers:

– To protect their own Personal Data and Consumer Information;

– To respect and protect the personal data of others;

– To provide full and accurate personal data, consumer information in accordance with law, under contract, or when consenting to personal data processing, consumer information.

– To comply with the laws on personal data protection, participate in the prevention of violations against personal data, and comply with the laws on protection of consumer rights.

6. Measures to protect and ensure information security; possible unintended consequences and damage arising during the Processing of Personal Data and Consumer Information

IIVC undertakes to keep Personal Data and Consumer Information confidential by all possible means. IVC will use various information security technologies as recommended by state authorities to protect Personal Data and Consumer Information from unauthorized attacks. However, due to technical limitations, no data transmitted over the Internet can be guaranteed to be 100% secure. Therefore, IVC cannot make any firm commitment that Personal Data and Consumer Information will be kept completely secure, and We shall not be liable in cases of unauthorized access to such data and information, including cases where the Personal Data Subject or Consumer voluntarily shares information with others.

7. Retention period: Personal Data and Consumer Information shall be retained for a period appropriate to the established purposes of processing, in accordance with agreements with the Personal Data Subject or Consumer and with applicable laws.

 

B. PROTECTION OF THE RIGHTS OF VULNERABLE CONSUMERS

1. Vulnerable consumers are those who are likely to be subject to significant disadvantages in terms of access to information, health, property, and dispute resolution at the time of purchasing or using products, goods, and services, including:

a. Elderly persons as defined by the laws on the elderly;

b. Persons with disabilities as defined by the laws on persons with disabilities;

c. Children as defined by the laws on children;

d. Ethnic minorities; persons living in ethnic minority and mountainous areas, islands, areas with difficult socio-economic conditions, or extremely difficult socio-economic conditions as defined by law;

e. Women who are pregnant or raising a child under 36 months of age;

f. Persons suffering from critical illnesses as defined by law;

g. Members of poor households as defined by law.

2. The protection of vulnerable consumer rights shall be implemented as follows:

a. Vulnerable consumers are guaranteed the rights of consumers in accordance with the provisions of this Policy, the Consumer Right Protection Law and priority rights and policies in accordance with other relevant laws;

b. When a vulnerable consumer submits a request for protection along with evidence and documentation proving their status as a vulnerable consumer and that their rights have been infringed, IVC and/or the dealers will give priority to receiving and handling the request, and will not forward it to a third party for resolution, unless such third party has relevant obligations. In case of refusal to handle the request, IVC and/or the dealers must provide a written response, clearly stating the legal basis and the inconsistency with the published policy as prescribed in Section 3, Part B of this Policy;

c. IVC and/or the dealers must compensate vulnerable consumers for damages in accordance with the provisions of civil law in case of any delay in, refusal to prioritize, or refusal to receive and handle requests as prescribed at Section 2.b, Part B of this Policy;

3. When transacting with vulnerable consumers, IVC and/or the Dealers shall have the following responsibilities:

a. Ensure the exercise of the rights of vulnerable consumers in the purchase and sale of products, goods and the provision of services in accordance with laws;

b. Ensure the right to file complaints, request dispute resolution, and exercise other rights of vulnerable consumers;

c. Apply processes, procedures, and methods of receiving and resolving complaints in a flexible manner, appropriate to each vulnerable consumer, based on their circumstances, access to information, ability to exercise rights, etc. This may include providing documents in easy-to-understand language, offering reading and writing support for the visually impaired, giving instructions in ethnic minority languages when necessary, or assigning staff to provide counseling and assistance to those who face difficulties in accessing information;

d. Do not refuse to handle protection requests from vulnerable consumers, as specified in Section 2.b, Part B of this Policy, on the grounds of differences in language, script, customs, or cultural practices;

e. Prevent discrimination, unequal treatment, or exploitation of vulnerabilities to infringe upon the lawful rights and interests of consumers during transactions;

f. Fulfill other responsibilities in accordance with the law on consumer right protection and other relevant legal regulations.

 

C. CHANGES TO THIS POLICY

This Policy may be updated from time to time, and any updated version will be posted on IVC’s website at: https://isuzu-vietnam.com. Personal data subject, Consumers are encouraged to visit the website regularly to check for any modifications.

 

D. EXERCISE OF THE RIGHTS OF PERSONAL DATA SUBJECTS AND CONSUMERS; METHODS FOR RECEIVING COMPLAINTS

Personal Data Subjects and Consumers may withdraw or modify their consent at any time. In addition, Personal Data Subjects and Consumers may exercise their rights or submit requests and complaints to Us by the following methods:
